IMPORTANT CUSTOMER INFORMATION

1. INTRODUCTION

Welcome to Anera Wireless (“Anera”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your purchase and use of Anera Wireless products and services, including SIM cards, wireless data connectivity, networking hardware, routers, and related services (collectively, the “Services”).

By activating, purchasing, or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. NATURE OF SERVICES

Anera Wireless provides cellular data services through third-party carrier networks and distributes related hardware such as SIM cards and industrial networking equipment.

⚠️ Important:

Anera does not operate its own cellular network. Many Services rely on third-party infrastructure, which is outside Anera’s direct control.

3. NO GUARANTEE OF SERVICE

THE SERVICES ARE PROVIDED ON AN “AS AVAILABLE” AND “BEST EFFORTS” BASIS.

Anera does not guarantee:

  • Continuous or uninterrupted connectivity
  • Coverage in all locations
  • Minimum data speeds or latency
  • Compatibility with all devices or environments

Wireless services may be affected by:

  • Carrier outages or congestion
  • Environmental or geographic interference
  • Signal strength and tower proximity
  • Equipment limitations

👉 Service interruptions and variability are inherent to wireless communications.

4. EQUIPMENT AND HARDWARE

Anera may provide routers, SIM cards, and related hardware (“Equipment”).

Equipment Limitations

  • Equipment is not guaranteed to operate without interruption
  • Performance depends on network conditions and installation
  • Devices may fail, degrade, or become obsolete

Anera is not responsible for:

  • Installation errors or misconfiguration
  • Third-party device compatibility
  • Changes to carrier networks or firmware
  • Hardware failure outside warranty terms

5. NOT A MISSION-CRITICAL SERVICE

 Critical Notice

Anera Wireless Services are NOT intended for:

  • Emergency communications
  • Life-support or medical monitoring
  • Public safety systems
  • Critical infrastructure control
  • Any application where failure could result in injury, loss, or damages

👉 You agree not to rely on the Services for such uses.

6. DATA USAGE AND BILLING

  • Data is billed according to your selected plan
  • Pooled plans share data across multiple SIMs
  • Dedicated plans apply per SIM

Overage and Usage

  • Overage charges apply where applicable
  • Some plans may auto-upgrade based on usage
  • Usage is determined solely by carrier data records

Anera is not responsible for:

  • Unexpected data usage
  • Misconfigured devices
  • Third-party software or applications

7. SUBSCRIPTIONS AND PAYMENTS

  • Services are billed in advance unless otherwise stated
  • Subscriptions automatically renew
  • Taxes and regulatory fees may change

Refund Policy

  • No refunds for partial billing periods
  • No refunds for unused data
  • No refunds due to outages or service interruptions

8. CUSTOMER RESPONSIBILITIES

You agree to:

  • Use the Services in accordance with applicable laws
  • Maintain proper device configuration
  • Monitor usage and billing
  • Safeguard account credentials

You are responsible for all activity associated with your account and SIM cards.

9. PROHIBITED USE

You may not use the Services:

  • For illegal or fraudulent activities
  • To disrupt networks or services
  • For unauthorized resale or redistribution
  • For mission-critical applications prohibited under Section 5

Anera reserves the right to suspend or terminate Services for violations.

10. THIRD-PARTY NETWORKS

The Services depend on third-party providers, including mobile network operators.

Anera is not responsible for:

  • Carrier outages or disruptions
  • Network throttling or prioritization
  • Coverage gaps
  • Changes in network technology

11. FORCE MAJEURE

Anera shall not be liable for any failure, interruption, or delay in performance caused by events beyond its reasonable control, including but not limited to:

  • Network outages or carrier failures
  • Natural disasters (fires, floods, earthquakes, etc.)
  • Severe weather conditions
  • Government actions or regulatory changes
  • Power failures or infrastructure outages
  • Supply chain disruptions
  • War, terrorism, or civil unrest
  • Labor disputes or strikes

During such events, Anera may suspend or modify Services without liability.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Anera shall not be liable for:

  • Loss of business, revenue, or profits
  • Loss of data
  • Service interruption or downtime
  • Equipment failure
  • Indirect, incidental, or consequential damages

Liability Cap

Anera’s total liability shall not exceed:

👉 The total amount paid by you in the previous three (3) months

13. NO WARRANTIES

All Services and Equipment are provided “AS IS” and “AS AVAILABLE.”

Anera disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Continuous or error-free operation
  • Compatibility with all systems

14. CANCELLATION

  • You may cancel Services at any time
  • No refunds will be provided for unused service
  • Equipment remains your responsibility unless otherwise stated

Anera may suspend or terminate Services for:

  • Non-payment
  • Violation of Terms
  • Carrier or regulatory requirements

15. MODIFICATION OF TERMS

Anera may update these Terms at any time.

Continued use of Services constitutes acceptance of the updated Terms.

16. GOVERNING LAW

These Terms are governed by the laws of:

17. DISPUTE RESOLUTION

All disputes shall be resolved through:

  • Binding arbitration, or
  • Small claims court where applicable
